IN THE SUPREME COURT OF NEW SOUTH WALES SYDNEY REGISTRY
COMMON LAW DIVISION File No:
AFFIDAVIT
I, John Wilson of 19 Elm Place, North Rocks in the State of New South Wales, say on oath:
1.I am the Deponent.
2.On the evening of Wednesday 27th
December 2000 two officers from the Office of the Sheriff rang the doorbell of my home at 19 Elm Place, North Rocks and served me with a NOTICE TO VACATE which the St. George Bank Limited are having issued as a result of
Justice Carolyn Simpson Judgment of 30th November 1999 following her UNLAWFULLY and MALICIOUSLY conducting proceedings in the matter of St. George Bank Limited -v- John and Laraine Wilson, File No: 11203/99 in the Supreme
Court of New South Wales, Queen's Square, Sydney.
3.The NOTICE TO VACATE is hereto annexed and marked "A" and the deadline on that document to vacate our home is "no later than 12:00 PM Thursday 11 January
2001".
4.Justice Carolyn Simpson's Judgment was handed down on 30 November 1999 which was three weeks after the Chief Judge at Common Law, Justice James Wood, UNLAWFULLY and MALICIOUSLY convicted me and sentenced me
to two years imprisonment without parole. I am presently suing the Crown because of that WRONG in the Supreme Court of New South Wales and the File No for that case is 20137/00.
5.Justice Simpson unlawfully and
maliciously denied me the right to trial by jury and the transcript of those proceedings are hereto annexed and marked "B"
6.Section 3 of the Supreme Court procedure Act 1900 No 49 states
"(1) In any action by consent of both parties the whole or any one or more of the issues of fact in question may be tried, or the amount of any damages or compensation may be assessed by a Judge without a jury.'
7.I most certainly did not consent to the proceedings being conducted without a jury. But vehemently argued right right to trial by jury and even filed a requisition for trial by jury. This was filed on 28 May 1999 and a copy
of that filing is annexed hereto and marked "C".
8.No judge has the power to deny that right and section 30 the Interpretation Act 1987 No: 15, saying "(1) The amendment or repeal of an Act or statutory
rule does not :…(c) affect any right, privilege, obligation or liability acquired, accrued or incurred under the Act or statutory rule,", is one example of legislation protecting such rights.
9.Justice Simpson's
concealing bank fraud - and by that I mean VARIABLE INTEREST RATE LOANS and the fact that banks CREATE THEIR OWN MONEY (both of, for which, I presented evidence in affidavits) - is JUDICIAL CORRUPTION.
10.I truly believe
that a COURT is a place where JUSTICE IS SUPPOSED TO BE ADMINISTERED but Justice Carolyn Simpson knowingly set about to PERVERT THE COURSE OF JUSTICE.
11.I truly believe that JUSTICE MUST BE RETURNED to these COURTS and
that the WRONGS done by Justice Carolyn Simpson must be REMEDIED.
